Privacy Notice – Native Pet

Native Pet (“Native Pet,” “we,” “our,” or “us”) respect your privacy and are committed to protecting it by complying with this privacy notice (“Privacy Notice”). We provide a number of Offerings for users on our Site, including pet supplies, pet supplements, merchandise, and gift cards. This Privacy Notice describes the type of information we may collect; who we may collect it from; our practices for collecting, using, maintaining, protecting, and disclosing that information when you visit our website at https://nativepet.com/ (“Site”) or in connection with the products and services available on the Site or otherwise offered by Native Pet (the products and services collectively, the “Offerings”).


Capitalized terms that are not defined in this Privacy Notice have the meaning given in our Terms of Use located at https://nativepet.com/policies/terms-of-service (the “Terms of Service”).

 

When the Privacy Notice Applies.

This Privacy Notice applies to information we collect:

  • when accessing the Offerings;
  • in email, text, and other electronic messages between you and us;
  • when you interact with our advertising on third-party websites;
  • when you interact with our Offerings on third-party websites; or
  • when you fill out any forms or similar that are directed to us.

It does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or on the website. How We Collect Your Information.

We collect the information:

  • directly from you when you provide it to us such as, when you register to use our Offerings, fill out forms on our Offerings, subscribe to our Offerings, when you enter a promotion sponsored by us, posting material to our Offerings, or request further Offerings;
  • records or copies of correspondences (including email address) if you contact us;
  • your response to surveys;
  • details of transactions carried out on our Offerings and of the fulfillment of your order, including refunds/returns;
  • your search queries on the Site;
  • automatically as you navigate the Site through automated data technologies such as cookies, web beacons and other tracking technologies; or
  • from third parties.

Cookies.

A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Offerings. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Offerings.


Information We Collect

We may collect the following types of information:

  • information by which you may be personally identified such as name, email, phone number, physical address, date of birth, or any other information which could be used to identify you (collectively, “personal information”);
  • information that is about you but individually does not identify you such as demographics and hobbies/interests;
  • information about your internet connection, the equipment you use to access our Offerings, including usage details and IP addresses;
  • details of your visits to our Offerings, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Offerings; or
  • information about your online activities over time and across third-party websites or other online services (behavioral tracking);
  • login information such as username and password; and
  • your pet’s name, date of birth, health information, and activity level.

How We Use Your Information.

We may use information that we collect about you or that you provide to us, including any personal information:

  • to present our Offerings to you or to provide you with information, products, or services you request from us;
  • to provide you with notices about your account or subscription, including expirations and renewal notices;
  • to carry out our obligations and enforce our rights arising from any contract entered into between you and us, including billing and collection; 
  • to notify you about changes to our Offerings; 
  • analyze and enhance our marketing communications and strategies;
  • analyze trends and statistics regarding use of the Offerings and transactions conducted using the Offerings; 
  • any other way we may describe when you provide the information; 
  • for any other purpose for which you provide it; or
  • with your consent.

Automated Data Tracking Technologies.

The information we collect automatically may include personal information. We may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Offerings and to deliver a better and more personalized service, including by enabling us to:

  • estimate our audience size and usage patterns;
  • store information about your preferences, allowing us to customize our Offerings according to your individual interests;
  • speed up your searches; or
  • recognize you when you return to our Offerings.

How We Share Your Information.

We may disclose information that is not personal information without limitation. We may disclose personal information that we collect or you provide as described in this Privacy Notice:

  • to contractors, service providers, and other third parties, including promotional or marketing partners, we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them;
  • to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Native Pet's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Native Pet about our Offerings users is among the assets transferred;
  • to fulfill the purpose to which you provide it;
  • for any other purpose disclosed by us when you provide the information; or
  • with your consent.

We may also disclose your personal information:

  • to comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • to enforce or apply the Terms of Service or other agreements, including for billing and collection purposes; or
  • if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Native Pet, our users, or other third parties. 

Links to Other Web Sites and Offerings.

We are not responsible for the practices employed by websites, applications, or services linked to or from our Offerings. We recommend you review the privacy notices of other applications before authorizing third-party access to data through the Offerings. 


Cookies.

Some content or applications, including advertisements, on the Offerings are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.


We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.


How We Protect Your Information

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.


The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Offerings, as stated in the Terms of Service, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Offerings like message boards or reviews. The information you share in public areas may be viewed by any user of the Offerings.


Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Offerings. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Offerings.


User Submitted Content.

You may provide information to be published or displayed (hereinafter, "posted") on public areas of the Offerings or transmitted to other users of the Offerings or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Offerings with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.


Retention of Your Information.

Storage Location. Information may be held at our offices and the offices of any third party agencies, service providers, and representatives that assists us with providing Offerings to you. 

 

Storage Cadence.

We will keep your personal information while you have an account with us or for as long as it necessary to provide the Offerings to you. Thereafter, we will keep your personal information for as long as is necessary:

  • to respond to any questions, complaints, or claims made by your or on your behalf;
  • to show that we treated you fairly; or
  • to keep records required by law.

SMS/MMS Mobile Messaging Program.

Native Pet offers a mobile messaging program (the “Program”) subject to all our policies, including the Terms of Service, this Privacy Notice, and all other Native Pet policies that are publicly available or given to you. 


User Opt-in.  The Program allows Users to receive SMS/MMS mobile messages by affirmatively opting into the Program, such as through online or application-based enrollment forms. Regardless of the opt-in method you utilized to join the Program, you agree that this Agreement applies to your participation in the Program. By participating in the Program, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in, and you understand that consent is not required to make any purchase from us. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of Native Pet’s mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”). Message and data rates may apply. Message frequency varies.


User Opt-out.  If you do not wish to continue participating in the Program or no longer agree to the Terms of Use, Privacy Notice, or any other publicly posted or otherwise distributed to you Native Pet policy, you agree to reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from us in order to opt out of the Program. You may receive an additional mobile message confirming your decision to opt out. You understand and agree that the foregoing options are the only reasonable methods of opting out. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that alter, change, or modify the STOP, END, CANCEL, UNSUBSCRIBE or QUIT keyword commands, such as the use of different spellings or the addition of other words or phrases to the command, and agree that Native Pet and its service providers will have no liability for failing to honor such requests.  You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.


  1. Program Description.  Without limiting the scope of the Program, users that opt into the Program can expect to receive messages concerning the marketing, promotion, payment, delivery and sale of pet nutritional supplements and other pet products. Messages may include checkout reminders. 

  1. Cost and Frequency.  Message and data rates may apply. You agree to receive messages periodically at our discretion. Daily, weekly, and monthly message frequency will vary. The Program involves recurring mobile messages, and additional mobile messages may be sent periodically based on your interaction with us.

  1. Support Instructions.  For support regarding the Program, text “HELP” to the number you received messages from or email us at info@nativepet.com. Please note that the use of this email address is not an acceptable method of opting out of the program. Opt-outs must be submitted in accordance with the procedures set forth in Section 9.2 above.

  1. MMS Disclosure.  The Program will send SMS TMs (terminating messages) if your mobile device does not support MMS messaging.

  1. Our Disclaimer of Warranty.  The Program is offered on an "as-is" basis and may not be available in all areas, at all times, and may not continue to work in the event of product, software, coverage or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with this Program. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of our control. Carriers are not liable for delayed or undelivered mobile messages.

  1. Participant Requirements.  You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.

  1. Florida Law.  We endeavor to comply with the Florida Telemarketing Act and the Florida Do Not Call Act as applicable to Florida residents.  For purposes of compliance, you agree that we may assume that you are a Florida resident if, at the time of opt-in to Program, (1) your shipping address, as provided is located in Florida or (2) the area code for the phone number used to opt-into the Program is a Florida area code.  You agree that the requirements of the Florida Telemarketing Act and the Florida Do Not Call Act do not apply to you, and you shall not assert that you are a Florida resident, if you do not meet either of these criteria or, in the alternative, do not affirmatively advise us in writing that you are a Florida resident by sending written notice to us.  Insofar as you are a Florida resident, you agree that mobile messages sent by us in direct response to mobile messages or requests from You (including but are not limited to response to keywords, opt-in, help or stop requests and shipping notifications) shall not constitute a “telephonic sales call” or “commercial telephone solicitation phone call” for purposes of Florida Statutes Section 501 (including but not limited to sections 501.059 and 501.616), to the extent the law is otherwise relevant and applicable.

Your Choices About Your Information.

We strive to provide you with choices regarding the personal information you provide to us. Below are options for your personal information.


Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Offerings may then be inaccessible or not function properly.


Targeted Advertising. We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. 


Disclosure of your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by sending us an email stating your request to Info@NativePet.com. Please note that your opt-out will not apply to any information already shared with third parties.


Promotional Offers from Native Pet. If you do not wish to have your email address used by us to promote our own or third parties' products or services, you can opt-out by sending us an email stating your request to info@nativepet.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt-out does not apply to information provided to Native Pet as a result of a product purchase, warranty registration, product service experience or other transactions.


Accessing and Correcting your Information.

You can review and change your personal information by logging into the Offerings and visiting your account profile page. If you wish to change information that is located on Shopify, you must contact Shopify directly. 


You may also send us an email at info@nativepet.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.


If you delete your User Contributions from the Offerings, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Offerings users. Proper access and use of information provided on the Offerings, including User Contributions, is governed by the Terms of Service.


Children Under the Age of 13.

Our Offerings are not specifically directed at children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Offerings or on or through any of its features/register on the Offerings, make any purchases through the Offerings, use any of the interactive or public comment features of this Offerings or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at info@nativepet.com. 


Changes to Our Privacy Notice.

If you do not agree to this Privacy Notice, do not use the Offerings. 


In our sole discretion, we may revise this Privacy Notice from time-to-time. The Last Revised date is set forth at the top of this page. All changes are effective 15 days after the Last Revised date for current users and immediately for new users. Your continued use of the Offerings following the posting of this Privacy Notice means you accept and agree to the Privacy Notice.
